Terms of Service

These terms explain what you can expect from NourishGo, and what we expect from you when buying or selling surplus food.

1. Who we are

NourishGo is a marketplace that connects people with quality surplus food from restaurants, bakeries, hotels, supermarkets, farmers and food processors in Kenya.

We are a marketplace, not a food producer. Vendors prepare, store, describe and hand over the food. We provide the platform, the payment flow and the standards vendors agree to follow.

2. Using your account

  • You must be at least 18 years old to create an account.
  • Give accurate details and keep your password private. You are responsible for activity under your account.
  • One person, one account. Vendors may hold one store per registered business.
  • Tell us immediately at hello@nourishgo.co.ke if you think someone else is using your account.

3. Reserving and paying

When you reserve an item we hold it for you and take you to our payment provider. If payment is not completed within the hold window, the reservation is released and the item returns to sale.

Prices are shown in Kenyan Shillings and include what the vendor charges for the item. The original price shown is the vendor's normal selling price for comparison.

  • A reservation is confirmed only after payment succeeds.
  • You receive a pickup code. Show it to the vendor to collect your order.
  • Surplus food is sold as available. Contents of surprise bags vary and cannot be chosen.

4. Collection, cancellations and refunds

You must collect within the pickup window shown on the listing. Food is prepared surplus with a short life, so uncollected orders cannot be held over and are not automatically refunded.

  • Unpaid reservations can be cancelled by you at any time before payment.
  • If a vendor cannot fulfil a paid order, or the food is not as described, contact us within 24 hours and we will investigate and refund where appropriate.
  • Refunds are returned through the original payment method and may take several working days to appear.

5. Rules for vendors

Reports from customers are reviewed by our team. Upheld reports remove the listing and add a strike to the store. Three upheld strikes suspends the store automatically.

  • Only list food that is safe, correctly described and genuinely surplus.
  • Hold the licences and food-handling approvals required for your business under Kenyan law.
  • List allergens accurately and honour the pickup window and price you publish.
  • Rescue prices must be at least 30% below your normal selling price.
  • Confirm each handover using the customer's pickup code.

6. Fees and payouts

Buyers pay the price shown at checkout. Where a commission or service fee applies to vendors, it is disclosed in the vendor agreement before any listing goes live. Payouts are made to the account details a vendor provides and is responsible for keeping accurate.

7. What we are responsible for

We work to keep the service available, accurate and secure, and to verify vendors before they sell. We are not responsible for the preparation, storage or condition of food, which remains the vendor's legal responsibility.

Nothing in these terms limits any liability that cannot be limited under Kenyan law, including liability for death or personal injury caused by negligence.

8. Suspension and ending your account

You can close your account at any time by contacting us. We may suspend or close an account that breaks these terms, puts people at risk, or is used fraudulently. We will tell you why unless we are legally prevented from doing so.

9. Changes and governing law

We may update these terms as the service grows. Material changes will be announced in the app or by email before they take effect.

These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute.
